Terms of Service

1. Acceptance

By downloading, installing, or using Voyeza you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of Victorian courts.

2. Eligibility & Age Requirement

You must be at least 16 years old to use Voyeza. This requirement complies with the Online Safety Amendment (Social Media Minimum Age) Act 2024 (Cth).

By creating an account you confirm that you are 16 or older. Accounts found to belong to users under 16 will be immediately terminated and all data deleted.

One account per person. You may not create accounts on behalf of others without their consent.

3. Your Content

You own all photos, videos, and captions you post to Voyeza
By posting content you grant Voyeza a worldwide, non-exclusive, royalty-free licence to display, store, and distribute your content within the app for the purpose of operating the service
You may revoke this licence at any time by deleting your content or your account
You confirm that you have the right to post any content you upload, including any people, places, music, or third-party material shown or heard
You are solely responsible for the content you post and any consequences of posting it

4. Prohibited Content & Behaviour

The following is strictly prohibited on Voyeza and may result in immediate account suspension without notice:

Nudity or sexual content of any kind
Content sexualising, endangering, or exploiting minors in any way
Harassment, bullying, threats, or targeted abuse of any person
Hate speech based on race, religion, gender, sexual orientation, nationality, disability, or any other characteristic
Image-based abuse (sharing intimate images without the subject's consent)
Violent, graphic, or disturbing content
Spam, fake accounts, or impersonation of other people or organisations
Illegal content of any kind under Australian law
Content that violates the Online Safety Act 2021 (Cth)
Automated scraping or extraction of data from the app

Violations of these rules — especially those involving minors or image-based abuse — will result in permanent account termination and may be referred to Australian law enforcement or the eSafety Commissioner.

5. Online Safety Obligations

Voyeza complies with the Online Safety Act 2021 (Cth) and the requirements of the eSafety Commissioner.

We will act on valid complaints and removal requests within 24 hours
We will comply with notices from the eSafety Commissioner
Users who repeatedly violate our safety rules will be permanently banned
We maintain records of reported content and our responses

To report a safety concern directly, use the report button in the app or email [email protected]. For urgent online safety matters contact the eSafety Commissioner at esafety.gov.au.

6. Australian Consumer Law

Nothing in these Terms of Service excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (ACL) — Schedule 2 of the Competition and Consumer Act 2010 (Cth) — that cannot be excluded by agreement.

Our services come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

7. Intellectual Property

The Voyeza app, name, logo, and design are owned by the developer and protected by intellectual property law
You may not copy, modify, distribute, sell, or reverse engineer the app or any part of it
You may not use the Voyeza name or logo without written permission
You may not scrape or extract data from the app by automated means

8. Account Suspension & Termination

You may delete your account at any time via Settings → Delete Account
We may suspend or terminate accounts that violate these Terms with or without notice
We may discontinue the Voyeza service with reasonable notice where possible
Upon termination all your data will be deleted per our Privacy Policy
Decisions to permanently ban accounts are final in cases involving child safety or image-based abuse

9. Limitation of Liability

To the maximum extent permitted by Australian law:

Voyeza is provided as-is without warranties of continuous uptime or error-free operation
We are not liable for content posted by users of the platform
We are not liable for indirect, incidental, or consequential losses arising from your use of the app
Our total liability to you for any claim will not exceed the amount you paid us in the 12 months preceding the claim (which is $0 if you use the free app)

This limitation does not affect your rights under the Australian Consumer Law which cannot be excluded.

10. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes through the app. Your continued use of Voyeza after changes are posted constitutes acceptance of the updated terms.
